Terms of Service and Policies

By signing up for services (“Service”) with Transformation Services, Inc. (DBA Transformation Academy TM) (hereby referred to as “Transformation Academy”) you are agreeing to be bound by the following terms, conditions and policies (“Terms of Service”). You can review the current version of the Terms of Service at any time at here. Transformation Academy reserves the right to update and change the Terms of Service by posting updates and changes to the Transformation Academy website. You are advised to check the Terms of Service from time to time for any updates or changes that may impact you.

You must read, agree with and accept all of the terms and conditions contained in this Terms of Service agreement, Transformation Academy’s Privacy Policy before you may become a Transformation Academy user.

01. Account Terms

1.You must be 18 years or older or at least the age of majority in the jurisdiction where you reside or from which you use this Service.
2.You must provide your full name, a valid email address, and any other information needed in order to complete the signup process.
3.You acknowledge that Transformation Academy will use the email address you provide as the primary method for communication.
4.You are responsible for keeping your password secure. Transformation Academy cannot and will not be liable for any loss or damage from your failure to maintain the security of your account and password.
5.A breach or violation of any term in the Terms of Service as determined in the sole discretion of Transformation Academy will result in an immediate termination of your account.

02. General Conditions

You must read, agree with and accept all of the terms and conditions contained in this User Agreement and the Privacy Policy before you may become a member of Transformation Academy.

3.You acknowledge and agree that your use of the Service, including information transmitted to or stored by Transformation Academy, is governed by its privacy policy.

03. Transformation Academy Rights

1.We reserve the right to modify or terminate the Service for any reason, without notice at any time.
2.We reserve the right to refuse service to anyone for any reason at any time.
3.Verbal or written abuse of any kind (including threats of abuse or retribution) of any Transformation Academy customer, Transformation Academy employee, member, or officer will result in immediate account termination.
4.In the event of a dispute regarding account ownership, we reserve the right to request documentation to determine or confirm account ownership. Documentation may include, but is not limited to, a scanned copy of your business license, government issued photo ID, the last four digits of the credit card on file, etc.

04. Limitation of Liability

1.You expressly understand and agree that Transformation Academy shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to, damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the service.
2.In no event shall Transformation Academy or our suppliers be liable for lost profits or any special, incidental or conse quential damages arising out of or in connection with our site, our services or this agreement (however arising including negligence). You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, Transformation Academy partners, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.
3.Your use of the Service is at your sole risk. The Service is provided on an "as is" and "as available" basis without any warranty or condition, express, implied or statutory.
4.Transformation Academy does not warrant that the Service will be uninterrupted, timely, secure, or error-free.
5.Transformation Academy does not warrant that the results that may be obtained from the use of the Service will be accurate or reliable.
6.Transformation Academy does not warrant that the quality of any products, services, information, or other material purchased or obtained by you through the Service will meet your expectations, or that any errors in the Service will be corrected.
7.In no event will Service Provider's aggregate liability for all claims of any kind, including any claims arising out of or related to this agreement, whether by statute, contract, tort, or under any other theory of liability, exceed the fees paid by you for the Transformation Academy Service hereunder during the one (1) month period immediately preceding the date on which the cause of action arose.

05. Waiver and Complete Agreement

The failure of Transformation Academy to exercise or enforce any right or provision of the Terms of Service shall not constitute a waiver of such right or provision. The Terms of Service constitutes the entire agreement between you and Transformation Academy and govern your use of the Service, superseding any prior agreements between you and Transformation Academy (including, but not limited to, any prior versions of the Terms of Service).

06. Cancellation and Termination

1.You may cancel your account at anytime by emailing contact@ransformationacademy.com and then following the specific instructions indicated to you in Transformation Academy's response.
2.For recurring payments, you must cancel your subscription before the end of a billing cycle to stop payment in the subsequent billing cycle.

07. Copyright Notice

The written materials and processes taught in the Life Coach Certification courses are intended for students to use with their own clients. Transformation Academy grants students of Certification courses this right, while working with both one-on-one clients, group coaching clients, and virtual clients. However, no part of the materials available through the site may be copied, photocopied, reproduced, translated or reduced to any electronic medium or machine-readable form, in whole or in part, and then sold through a book, ebook, or online course, without prior written consent of Transformation Academy. Any other reproduction in any form without the permission Transformation Academy is prohibited. All materials contained on this site are protected by United States copyright law and may not be reproduced, distributed, transmitted, displayed, published or broadcast without the prior written permission of Transformation Academy.

08. Disability Policies

Transformation Academy is committed to ensuring students with disability are able to take our programs in an environment that values diversity, inclusion and participation. For this reason, we provide our programs virtually, so that people can access them from their home anywhere in the world. We also serve those with blindness by making sure our websites are screen-reader and tabbing friendly. For the deaf we can provide captions for a specific course, if requested. We provide visual, audio, and written material throughout our programs in order to meet the diverse needs of learners with disability that require alternative learning styles.

09. Equal Treatment

Text Messaging Terms Of Use

Consent to Receive Text Messages: By providing your mobile number and opting in, you agree to receive text messages (SMS/MMS) from TransformationAcademy. These messages may include updates, promotional offers, and other information related to our products and services.

Opt-In: You can opt-in to receive text messages by [specific action, e.g., signing up on our website, texting a keyword to a short code, etc.]. Your consent to receive these messages is not a condition of purchase.

Message Frequency: The number of text messages you receive will vary depending on your interactions with TransformationAcademy. Typically, you can expect to receive 8 per month.

Opt-Out: You may opt-out of receiving text messages at any time by replying “STOP” to any text message you receive from us. Upon receiving your opt-out request, we will send you a confirmation message and will no longer send you text messages, unless you opt-in again.

Message and Data Rates:Message and data rates may apply to each text message sent or received according to your mobile service provider’s plan. If you have any questions regarding your text or data plan, please contact your wireless carrier.

Privacy and Data Use: We respect your privacy. Any personal information you provide in connection with text messaging will be handled in accordance with our Privacy Policy. We do not share your information with third parties except as required by law or as described in our Privacy Policy.

Changes to Terms: We may modify these Text Messaging Terms and Conditions at any time. If we make material changes, we will notify you by text message. Your continued participation in our text messaging program will constitute your acceptance of those changes.

10. 30-Day Money Back Guarantee and Refund Policy

At Transformation Academy, we want to ensure that you are satisfied with your purchase. If you have concerns, complaints, or questions, please feel free to connect to us at contact@ransformationacademy.com However, if you have attempted to resolve your issue with our support staff and you decide that our course does not meet your requirements, we ask that you email the address above with your request for a refund, within 30 days of making your purchase. Although we'd love to know how we can improve or how we could make our course a 5-star experience for you, you are welcome to follow the steps below for a full, no-questions-asked, refund. Please note that although we make every effort to refund your purchase quickly, our payment processor (Stripe) or your financial institution may have limitations that could make it take up to 20 days for the refund to reflect in your bank account/card.

Follow the steps below to get your refund request sent to us:

2.Submit a message with your name, email address, and order number or specific program purchased so we can issue a refund as quickly as possible.
3.Please also feel free to share any feedback, although this is in no way required and does not impact your ability to receive a refund (as long as the request is within 30 days of your purchase).
4.Once you submit the support request you will receive an auto response from us. That just lets you know we've got your request.
5.Once we've had a chance to review your request we will be in touch confirming the refund has been processed, within 48 hours.
6.If you are cancelling a membership program and wish to request continued access to courses you completed 100%, include this request and your list of completed courses in your message to us.

11. Life Coaching Disclaimer

Transformation Academy does not endorse, is not responsible for, and cannot be held liable for the actions of any student who enrolls in programs offered by Transformation Academy, including those who receive life coach certifications. Life coaches must be aware of and strictly adhere to the appropriate role of a life coach. Life coaches are not licensed health care providers or therapists and must not provide medical advice, engage in patient diagnosis, or practice therapy. They do not treat or otherwise counsel those with mental illness. Life coaches are obligated to refer clients in need of mental or physical health therapy to an appropriate licensed professional. While counselors or therapists often deal with a patient's mental/emotional conditions and/or processing trauma, a life coach never addresses such issues. The role of a life coach, in its most simple form, is to encourage, coach and/or act as a facilitator of a client's self-reflection, decision making, planning for the future, and creating life changes. While clear boundaries exist between coaching and therapy, due to the legal obligations and requirements for practicing therapy, there are many similarities. Both therapists and coaches work one-on-one with clients in an ongoing relationship. Certain psychological principles and theoretical frameworks are used in both therapy and coaching in order to facilitate positive life change. Under no circumstances should a life coach refer to themselves as a therapist, refer to what they do as therapy, or practice as a mental health counselor or therapist without the required Master's level degree and/or license.

We do not knowingly provide services or sell products to children. If you are below the age of 16, you may use our website only with the permission and active involvement of a parent or legal guardian. If you are a minor, please do not provide us or other website visitors with any personal information and do not use this website. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.

3. Collecting Personal Information from Customers

Your privacy is important to us! Below is the information we collect from our customers. In order to offer our Services, we need to collect information from our customers. Here is a summary of the information that we collect from our customers and what we do with it:

We collect the name, email, and any other personal information from our customers. Name and email are needed to allow individuals to access our Services for processes such as processing enrollments, authentication, or otherwise ad ministering our courses. This information is given on a voluntary basis when a customer uses or accesses our Services, for example when a customer visits a Transformation Academy site, enrolls in a course, or signs up for an account on a Transformation Academy site.
As a student progresses through our course(s) we collect information about how they interact with the course, including but not limited to, their progress through the course, quiz scores, survey results, discussion or forum contributions and other student activities.
Some transactions may involve payment by credit card, debit card, checks, money orders, and/or third party online payment services. In such transactions, we will collect information related to the transaction as part of the course of doing business with you, including a billing address, telephone number, and other information related to the transaction.

4. Information from Transformation Academy Website Visitors

We collect information from visitors to the Transformation Academy website. We collect information such as when you visited, the website from where you came prior to visiting us, the website where you go when you leave our website, your computer's operating system, location data, and the type of web browser that you are using. We also collect Personal Information submitted by you via any messaging or email feature available from any of our websites.

From telephone support users, we collect your name and phone number.
From support users (people who email us for support), we collect your name, email address, location, Transformation Academy site address, and email conversation with a Transformation Academy representative.
We use this information to provide and enhance our Services (including servicing your account, if applicable), and answer any questions you may have.

5. Information from Cookies and Similar Tracking Technology

We collect cookies or similar tracking technologies. This means information that our website's server transfers to your computer. This information can be used to track your session on our website. We follow industry standards on information security management to safeguard sensitive information, such as financial information, intellectual property, employee details and any other Personal Information entrusted to us. The safety and security of your information also depends on you. Where we have given you (or where you have chosen) a username and password for access to certain parts of our website, you are responsible for keeping the username and password confidential. Data Processing Addendum

This Transformation Academy Data Processing Addendum (“Addendum”) amends the Transformation Academy Terms of
Service (the “Agreement”) by and between you and Transformation Academy.

1. Definitions

(a) "Data Protection Legislation" refers to European Directives 95/46/EC and 2002/58/EC, and any legislation and/or regulation implementing or made pursuant to them, or which amends or replaces any of them (including the General Data Protection Regulation, Regulation (EU) 2016/679);

(b) "Data Processor", "Data Subject", "Processor", "Processing", "Subprocessor", and "Supervisory Authority" shall be interpreted in accordance with applicable Data Protection Legislation;

(c) "Personal Data" as used in this Addendum means information relating to an identifiable or identified Data Subject who visits or engages with or participates in your online course or site (a "Learner"), which Transformation Academy Processes as a Data Processor in the course of providing you with the Services. Notwithstanding the foregoing sentence, Personal Data does not include information that Transformation Academy processes in the context of services that it provides directly to a consumer, and

(d) All other capitalized terms in this Addendum shall have the same definition as in the Agreement.

2. Data Protection

2.1.Where a Data Subject is located in the European Economic Area, that Data Subject's Personal Data will be processed by Transformation Academy based in Canada. As part of providing the Services, this Personal Data may be transferred to other regions, including to Canada and the United States. Such transfers will be completed in compliance with relevant Data Protection Legislation.

2.2. When Transformation Academy Processes Personal Data in the course of providing the Services, Transformation Academy will:

2.2.1. Process the Personal Data as a Data Processor, only for the purpose of providing the Services in accordance with documented instructions from you (provided that such instructions are commensurate with the functionalities of the Services), and as may subsequently be agreed to by you. If Transformation Academy is required by law to Process the Personal Data for any other purpose, Transformation Academy will provide you with prior notice of this requirement, unless Transformation Academy is prohibited by law from providing such notice;

2.2.2. notify you if, in Transformation Academy's opinion, your instruction for the processing of Personal Data infringes applicable Data Protection Legislation;

2.2.3. notify you promptly, to the extent permitted by law, upon receiving an inquiry or complaint from a Data Subject or Supervisory Authority relating to Transformation Academy's Processing of the Personal Data;

2.2.4. implement and maintain appropriate technical and organizational measures to protect the Personal Data against unauthorized or unlawful processing and against accidental loss, destruction, damage, theft, alteration or disclosure. These measures shall be appropriate to the harm which might result from any unauthorized or unlawful processing, accidental loss, destruction, damage or theft of Personal Data and appropriate to the nature of the Personal Data which is to be protected;

2.2.5. notify you promptly upon becoming aware of and confirming any accidental, unauthorized, or unlawful processing of, disclosure of, or access to the Personal Data;

2.2.6. ensure that its personnel who access the Personal Data are subject to confidentiality obligations that restrict their ability to disclose the Customer Personal Data; and

2.2.7. upon termination of the Agreement, Transformation Academy will promptly initiate its purge process to delete or anonymize the Personal Data. If you request a copy of such Personal Data within 60 days of termination, Transformation Academy will provide you with a copy of such Personal Data.

2.3 In the course of providing the Services, you acknowledge and agree that Transformation Academy may use Subprocessors to Process the Personal Data. Transformation Academy's use of any specific Subprocessor to process the Personal Data must be in compliance with Data Protection Legislation and must be governed by a contract between Transformation Academy and Subprocessor.

(b) "Data Processor", "Data Subject", "Processor", "Processing", "Subprocessor", and "Supervisory Authority" shall be interpreted in accordance with applicable Data Protection Legislation;

(c) "Personal Data" as used in this Addendum means information relating to an identifiable or identified Data Subject who visits or engages with or participates in your online course or site (a "Learner"), which Transformation Academy Processes as a Data Processor in the course of providing you with the Services. Notwithstanding the foregoing sentence, Personal Data does not include information that Transformation Academy processes in the context of services that it provides directly to a consumer, and

(d) All other capitalized terms in this Addendum shall have the same definition as in the Agreement.

3. Miscellaneous

3.1 In the event of any conflict or inconsistency between the provisions of the Agreement and this Addendum, the provisions of this Addendum shall prevail. For avoidance of doubt and to the extent allowed by applicable law, any and all liability under this Addendum, including limitations thereof, will be governed by the relevant provisions of the Agreement. You acknowledge and agree that Transformation Academy may amend this Addendum from time to time by posting the relevant amended and restated Addendum on Transformation Academy's website (https://www.Transformation Academy.com/resources/dpa/), and such amendments to the Addendum are effective as of the date of posting. Your continued use of the Services after the amended Addendum is posted to Transformation Academy's website constitutes your agreement to, and acceptance of, the amended Addendum. If you do not agree to any changes to the Addendum, do not continue to use the Service.

3.2 Save as specifically modified and amended in this Addendum, all of the terms, provisions and requirements contained in the Agreement shall remain in full force and effect and govern this Addendum. If any provision of the Addendum is held illegal or unenforceable in a judicial proceeding, such provision shall be severed and shall be inoperative, and the remainder of this Addendum shall remain operative and binding on the parties.

3.3 The terms of this Addendum shall be governed by and interpreted in accordance with the laws of the Province of British Columbia and the laws of Canada applicable therein, without regard to principles of conflicts of laws. The parties irrevocably and unconditionally submit to the exclusive jurisdiction of the courts of the Province of British Columbia with respect to any dispute or claim arising out of or in connection with this Addendum.
